“No Surprises Act” brings changes to Employer-Sponsored Group Plans

The Consolidated Appropriations Act, 2021 (the CAA) was signed into law on December 27, 2020, containing provisions that will likely be quite a surprise to employers that provide group health coverage to their employees.  The CAA includes the “No Surprises Act” which generally prohibits balance billing from out-of-network providers and generally requires the cost-sharing for out-of-network emergency services and air ambulance providers to be the same as for in-network providers.  The new 30-day negotiation period for group health plans to settle out-of-network claims with providers and a new independent dispute resolution process provided under the No Surprises Act will require significant changes to employers’ group health plans.  We will also discuss the various other patient protections included in the No Surprises Act that will have an impact on employer-sponsored group health plans.
